Terms of Service

By creating an account or using Formotion AI ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

Formotion AI turns a creative brief into a generated motion graphics package: brand spec, poster layout, motion storyboard, designer handoff pack, and AI prompts for third-party tools such as Runway, Pika, and Midjourney. Output is generated using AI based on the inputs you provide.

You must provide accurate information when creating an account and keep your password secure. You are responsible for all activity under your account. You must be at least 16 years old to use the Service.

Formotion AI is offered on Creator, Studio, and Agency subscription tiers, billed monthly via Stripe. Subscriptions renew automatically until cancelled. You can cancel at any time and will retain access until the end of your current billing period. Prices may change with notice to existing subscribers.

You retain all rights to the creative briefs, brand information, and any material you upload.

Subject to you having an active, paid subscription and having paid all applicable fees, you own the brand specs, layouts, storyboards, and rendered assets generated for your projects, and may use them commercially.

We retain all rights to the Formotion AI platform, prompt library, motion curve system, and pipeline architecture itself. You are licensed to use the output, not the system that produces it.

Any content you subsequently generate in Runway, Pika, Midjourney, or similar tools using our prompt bundles is subject to those platforms' own terms.

You agree not to use Formotion AI to generate content that infringes someone else's intellectual property, trademark, or likeness rights; to generate unlawful, defamatory, or harassing content; to attempt to reverse-engineer or resell access to the Service; or to circumvent usage limits on your plan. We may suspend or terminate accounts that violate this section.

The Service is provided "as is." We do not guarantee that generated output will be error-free or fit for every use case; you are responsible for reviewing generated content before using it commercially. AI-generated content can occasionally be inaccurate or unexpected.

To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential damages.

Your creative briefs are sent to Anthropic's Claude API to generate output. By using the Service you consent to this processing. We are not responsible for Anthropic's own terms, uptime, or model behaviour.

We aim for high uptime but do not guarantee uninterrupted access. Maintenance and third-party dependencies can affect availability outside our control.

You may delete your account at any time. We may suspend or terminate your account for violating these terms, non-payment, or abusive behaviour, with notice where reasonably possible.

We may update these terms. Material changes will be notified by email or in-app notice before they take effect.

These terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.
